reservation conditions / rental agreement

1. Booking / rental item
With the booking for the stay in the Penthouse St.Helena in Parcines, the tenant offers the landlord the conclusion of a binding rental contract. This can be done in writing, verbally, online or by telephone. The short-term rental contract for the top floor apartment of the Residence St.Helena in Stampfstr. 8 in I-39020 Parcines (Penthouse St.Helena) comes into effect upon acceptance by the landlord. It is considered complete when the landlord sends the reservation confirmation or invoice to the tenant and the tenant pays the deposit. By paying the deposit, the tenant accepts the reservation conditions. The object is completely furnished. The equipment list is in the appendix. The landlord reserves the right to withdraw from the contract in the event that the deposit or the final payment is not received by the landlord on time.

2. Maximum number of people
The maximum number of people is limited to 4 people (including children under the age of 14). The personal costs (e.g. laundry packages) are calculated for the number of holiday guests according to the booking confirmation. If the tenant would like to register additional holiday guests up to the maximum number of people, the personal costs per registered person according to the price table must also be paid.

3. Rental Period
The rental agreement is valid for the period specified on the reservation confirmation.
Check-in on the day of arrival is at 4 p.m. at the earliest.
The penthouse must be vacated by 10:00 a.m. at the latest on the day of departure.
The keys are handed over on the day of arrival and departure using an electronically secured key box. The tenant will receive the operating instructions and the access code by e-mail a few days before the day of arrival. However, the access code will only be sent after the invoice has been paid in full.

4. Minimum Stay
The Penthouse St.Helena is to be rented for the number of nights indicated in the reservation confirmation. The minimum stay is 6 nights. If the number of nights specified in the booking confirmation is less than the minimum stay, the minimum number of nights will always be charged.

5. House Rules
The tenant agrees to follow the house rules. This applies to everyone in the Reservation confirmation listed persons as well as for guests of the tenant. The house rules can be found in the appendix.

6. Access to Rental Property
The tenant allows the landlord or his authorized representative access to the apartment during the rental period in the event of emergencies, inspections or repairs/maintenance measures. The landlord announces the necessary access to the rental property 24 hours in advance (except in the case of an emergency).

7. Rental Price and Payment
The rental price including all booked services is stated on the reservation confirmation or invoice. Upon receipt of the reservation confirmation or invoice by the tenant, 25% of the invoice amount is due as a deposit. The remaining 75% is due 30 days before departure. In the case of short-term bookings, the total price is due upon receipt of the invoice. Payment can be made by bank transfer to the lessor’s account. Payment by Paypal is also possible, the service fees for this are to be borne by the tenant.

8. Cancellation, No-Show
The tenant can cancel his booking free of charge up to 3 months before the start of the trip. In this case, the deposit already paid (excl. any payment processing fees) will be refunded. For cancellations up to 2 months before the start of the trip, the deposit will be retained as a cancellation fee. For cancellations up to 1 month before departure, 75% of the travel price must be paid. In the case of cancellations at short notice, late arrival or early departure, the entire invoice amount must be paid.
We recommend the products of ERGO travel insurance so that you are compensated for possible financial losses in the event of cancellation or termination of your stay, e.g. due to illness, accident or unemployment – also within the family.

9. Utilities / Laundry
The costs for electricity, water and heating are included in the rent. The cost of the final cleaning will be charged in addition to the cost of the stay. Bed linen/towels and bathrobes are charged per person in the form of a linen package. Intermediate cleaning and additional laundry packages can be ordered for a fee. You have to bring your own bedding for a travel cot. 10. Force Majeure
If the fulfillment of the rental contract is made directly and significantly more difficult, endangered or impaired as a result of force majeure (natural disasters, war, civil unrest), both parties can withdraw from the rental contract.

11. Condition of the rented property, exclusion of liability
The penthouse St.Helena has high-quality furniture and equipment and an extensive inventory. A full inventory list is included in the appendix. Minor deviations, in particular with regard to individual equipment features, from the illustrations shown on the Internet or elsewhere are possible and do not constitute a defect. If the lessee finds major deviations, he must inform the lessor immediately. In the event of a defect in the rented property that was not caused intentionally or through gross negligence by the lessor, the lessor’s liability for damages due to non-performance is excluded.

12. General Obligations
The penthouse may only be occupied and used by the agreed number of people (adults and children, including any extra beds). In the event of overcrowding, we reserve the right to turn away unregistered persons. All guests are required to comply with the applicable house and sauna rules. Violating the house and sauna rules can result in eviction from the penthouse without the rental price being reimbursed in whole or in part. All rental items that were damaged or lost during the stay must be replaced by the tenant. The tenant is obliged to report all defects and damage that occur during the rental period immediately. The tenant is responsible for proving that damage did not occur during his rental period and that he or the persons accompanying him are not at fault. The registering tenant is personally liable for all fellow travelers. Smoking in the apartment (kitchen, living and sleeping areas, bathrooms and sauna area), in the stairwell and in the whirlpool area is not permitted. In the event of infringement, the landlord is entitled to terminate the apartment without notice and to have it vacated and to pass on all costs due to consequential damage to the tenant without deduction. During the stay, each tenant is obliged to keep the penthouse clean himself. On the day of departure, the penthouse must be handed over in a swept state (empty the trash can, dispose of bottles and paper properly, wash up, empty the dishwasher). Costs incurred for necessary clean-up work after departure will be charged separately.

13. Pets
Please understand that pets are not allowed in our penthouse.

14. Lessor Liability
The contractual liability of the lessor is limited to the amount of the agreed rental price. The landlord is not liable for items brought into the apartments.

15. Südtirol Guest Pass
Upon completion of the accommodation contract, the Südtirol Alto Adige Guest Pass (consequently Guest Pass) will be issued to the guest, which according to the decision of the South Tyrolean regional government No. 732/2022, is valid for the entire duration of their stay as well as from 0:00 on the day of arrival unto 24:00 on the day of departure.
The Guest Pass includes the use of all public transport within the “südtirolmobil” network area as well as additional services, which vary depending on the tourism organization. Detailed information can be found at: https://suedtirol-guestpass.info
The sole entity carrying the Guest Pass in South Tyrol is the Mobilitätskonsortium, appointed as the unified coordination point in accordance with the above decision of the South Tyrolean regional government by the Provincial Association of Tourism Organizations of South Tyrol on November 16, 2022.The details of the additional services associated with the Guest Pass and the conditions of use of the Guest Pass are communicated by the third party responsible for issuing and managing the Guest Pass. 16. Severability Clause
Should one of these provisions be ineffective, the effectiveness of the others will not be affected.
